EGGE MACHINE COMPANY – TERMS & CONDITIONS OF SALE

1. Acceptance of Terms

These Terms and Conditions of Sale (“Terms”) govern all sales of products and services by Egge Machine Company (“Egge,” “we,” “us,” “our”). By placing an order, the customer agrees to be bound by these Terms. Any customer‑provided terms are expressly rejected unless agreed to in writing by Egge.

These Terms operate alongside Egge’s Privacy Policy and General Limited Warranty and Return Policy, which remain fully in effect.

2. Pricing and Payment

Invoices are payable within 21 working days, unless otherwise stated on the invoice or order confirmation.

If payment is not received by the due date:

    • A fixed interest charge of 10% of the outstanding balance may be applied.
    • Egge may suspend fulfillment of any pending orders or services without prior notice.

If payment remains outstanding more than 60 days after the due date:

    • Egge may engage a debt recovery service.
    • All associated legal and collection costs will be the responsibility of the customer.

International Withholding Taxes

Some countries require withholding taxes on invoice amounts. Any such withholding must be paid by the customer directly to their tax authority. Egge invoices must be paid in full, without deductions for foreign tax obligations.

3. Orders and Acceptance

All orders are subject to acceptance by Egge. We may refuse or cancel orders due to product availability, pricing errors, suspected fraud, or other legitimate business reasons.

4. Shipping and Delivery

Shipping dates are estimates only. Risk of loss transfers to the customer once the order is handed to the carrier.

Egge is not responsible for delays caused by carriers, customs, weather, or other external factors. International shipments may be subject to duties, taxes, or delays outside Egge’s control.

5. Warranty and Returns

All warranty and return matters are governed exclusively by Egge’s General Limited Warranty and Return Policy, including:

  • 6‑month limited warranty on Egge‑manufactured products
  • 90‑day limited warranty on pistons and piston pin assemblies
  • 30‑day limited warranty on remanufactured water pumps
  • Pre‑authorization required for all returns
  • Possible 15% restocking fee
  • No coverage for labor, incidental, or consequential damages
  • International returns must be pre‑approved and returned at customer expense

​These provisions supersede any conflicting warranty language elsewhere.

6. Claims and Inspection

Customers must inspect all goods immediately upon delivery.

To be valid, any claim must be submitted in writing to Egge’s registered office within 8 days of delivery. Claims submitted after this period may be rejected.

7. Suspension of Services

Egge reserves the right to suspend order processing, shipping, or any related services without prior notice if a customer account becomes past due.

8. Limitation of Liability

Egge’s liability is limited to:

  • Repair or replacement of the product, or
  • Refund of the original purchase price

​Egge is not liable for:

  • Labor charges
  • Improper installation
  • Abuse, misuse, or racing applications
  • Normal wear
  • Incidental or consequential damages

Egge cannot be required to appear as a third party in claims between the customer and an end consumer.

9. User‑Submitted Content

All media, files, photos, documents, or other content submitted to Egge are governed by the User‑Provided Media & Content section of the Privacy Policy.

This includes:

  • Customer service submissions
  • Technical support materials
  • Ask Bob submissions
  • Testimonials and public media

By submitting content, you grant Egge the licenses and permissions described in the Privacy Policy.

10. Intellectual Property

All content on the Site — including text, images, logos, product data, and media — is the property of Egge or its licensors. You may not copy, reproduce, or distribute any content without written permission.

11. Privacy

Your use of the Site is governed by Egge’s Privacy Policy, which outlines:

What information is collected

How it is used

How media submissions are handled

Your rights and choices

The Privacy Policy is incorporated into these Terms by reference.

12. Governing Law

All contractual relations are governed exclusively by the laws of the United States and the State of California.

13. Changes to Terms

Egge may update these Terms at any time. Changes take effect immediately upon posting. Continued use of the Site constitutes acceptance of the updated Terms.
